By using SabaRX, you agree to receive healthcare services through telehealth technologies.

SabaRX and the telehealth platform are NOT intended for medical emergencies.

I. INTRODUCTION
This Telehealth Informed Consent (“Consent”) describes the terms and conditions applicable to telehealth services provided through the SabaRX platform.
FourConcept Marketing LLC d/b/a SabaRX (“SabaRX”) provides administrative, technology, customer support, and marketing services in connection with the telehealth platform.
Medical services are provided exclusively by independent licensed healthcare providers affiliated with OpenLoop Health Care Partners, P.C. (“OpenLoop”).
By using the telehealth platform or continuing with services, you acknowledge that you have read, understood, and agreed to the terms contained in this Consent.
II. TELEHEALTH SERVICES
Telehealth involves the delivery of healthcare services using electronic communications, technology platforms, video conferencing, messaging systems, audio communications, and related technologies.
Healthcare providers may use telehealth to:
- Evaluate medical conditions;
- Recommend treatment options;
- Prescribe medications where appropriate;
- Monitor treatment progress;
- Provide follow-up care; and
- Communicate healthcare information.
Electronic systems utilized by the platform incorporate commercially reasonable security protocols designed to protect the confidentiality and integrity of medical information transmitted electronically.
III. POTENTIAL BENEFITS OF TELEHEALTH
Potential benefits of telehealth services may include:
- Improved access to healthcare services;
- Increased convenience;
- More efficient communication with healthcare providers;
- Access to healthcare providers across geographic distances; and
- Enhanced continuity of care.
No specific outcome or result is guaranteed.
IV. RISKS OF TELEHEALTH
Potential risks associated with telehealth services may include:
- Technical failures or interruptions;
- Delays in medical evaluation or treatment due to technology issues;
- Incomplete or inaccurate information transmission;
- Limitations associated with the inability to perform certain in-person examinations;
- Unauthorized access to electronic communications despite reasonable security safeguards; and
- Potential medication interactions or adverse reactions if complete medical history information is unavailable.
You understand that telehealth may not be appropriate for all medical conditions or situations.
V. PATIENT ACKNOWLEDGMENTS
By using the telehealth platform, you acknowledge and understand that:
- You may withhold or withdraw consent to telehealth at any time, subject to applicable law;
- Withdrawal of consent may impact the ability to continue receiving services through the platform;
- Alternative healthcare options, including in-person care, may be available;
- You are responsible for providing accurate and complete medical information;
- You should inform healthcare providers of all medications, allergies, treatments, and healthcare providers involved in your care;
- No guarantees or assurances have been made regarding treatment outcomes; and
- Telehealth services may involve electronic communication of medical information.
VI. HIPAA ACKNOWLEDGMENT
Protected health information (“PHI”) will be used and disclosed in accordance with applicable federal and state laws, including the Health Insurance Portability and Accountability Act (“HIPAA”).Healthcare providers and authorized service providers may access PHI as necessary for:
- Treatment;
- Payment;
- Healthcare operations; and
- Other legally permitted purposes.
SabaRX utilizes third-party vendors and technology providers, including Immuto, Inc. d/b/a Tellescope (“Tellescope”), which may process information in connection with telehealth platform operations subject to applicable privacy and security obligations.
You acknowledge receipt or availability of the applicable Notice of Privacy Practices.
VII. COMMUNICATION CONSENT
By providing your contact information, you consent to receive communications related to your account and services, including:
- Telephone calls;
- SMS/text messages;
- Emails;
- Appointment reminders;
- Service notifications; and
- Administrative communications.
Message and data rates may apply.
You may opt out of marketing communications at any time; however, certain operational or healthcare-related communications may still be necessary.
VIII. FINANCIAL RESPONSIBILITY AND AUTO-RENEWAL TERMS
You acknowledge financial responsibility for all services, subscriptions, consultations, products, prescriptions, laboratory services, shipping fees, and related charges associated with your participation in the program.
You authorize authorized payment processors to charge your payment method for:
- Services rendered;
- Recurring subscription charges;
- Membership fees;
- Prescription-related services; and
- Outstanding balances owed.
Certain programs may automatically renew unless canceled before the applicable renewal date. By enrolling in a recurring program, you authorize recurring charges in accordance with the disclosed billing terms.
Cancellation requests must be submitted before the renewal processing date to avoid future charges.
Except where prohibited by law, fees for services already rendered, consultations completed, medications dispensed, or custom products processed may not be refundable.Nothing in this Consent limits any non-waivable rights under applicable consumer protection laws.
IX. PRESCRIPTION AND PHARMACY DISCLOSURES
Prescription medications, if prescribed, are dispensed only by appropriately licensed pharmacies in accordance with state and federal law.
Prescribing decisions are made solely by independent licensed healthcare providers based on professional medical judgment.
SabaRX does not manufacture, compound, dispense, or prescribe medications.Shipping and delivery times are estimates only and are not guaranteed. Delays caused by pharmacies, carriers, weather, supply chain issues, or regulatory requirements may occur.
To the maximum extent permitted by law, SabaRX shall not be liable for shipping delays or carrier-related delivery issues outside its reasonable control.
X. LIMITATIONS OF SERVICES
Telehealth services may not be available in all states or jurisdictions.
Healthcare providers retain sole discretion regarding:
- Medical appropriateness;
- Eligibility for treatment;
- Prescription decisions; and
- Continuation or discontinuation of care.
No provider-patient relationship is created with SabaRX.
XI. CHANGES TO THIS CONSENT
We may revise this Consent periodically to reflect operational, legal, or regulatory changes.
Updated versions will be posted at: SabaRX.com
Continued use of the platform constitutes acceptance of revised terms.
XII. FLORIDA WEIGHT-LOSS CONSUMER NOTICE
For Florida residents, additional rights may apply under Florida law, including the Florida Weight-Loss Consumer Bill of Rights.
Consumers are encouraged to consult their personal physician before beginning any weight-loss program.
